Os impactos ambientais do lixão
Sobre os impactos ambientais do lixão a céu aberto, eles variam conforme a localização, se está perto ou longe de cursos d’água, do volume, das caraterísticas gravimétricas dos resíduos descartados e dependem também da distância do lençol freático da superfície. O lixão é uma forma irregulae e inadequada de disposição final de resíduos sólidos, que se caracteriza pela simples descarga do lixo sobre o solo, sem medidas de proteção ao meio ambiente ou à saúde pública. É um depósito amontoado de resíduos sólidos urbanos, composto por diversos materiais, tais como: papel, plásticos, papelões, madeira, vidro, madeira, resíduo de poda e galhada de árvores e principalmente por matéria orgânica. Os impactos mais comuns são: produção de forte odor do material putrefato e em decomposição; atração de animais e insetos transmissores de doenças. O líquido percolado ou lixiviado do chorume, se forma a partir da decomposição de matéria orgânica, e dá origem a este liquido poluente, escuro e fétido, que se espalha na superfície do lixão, se acumula em depressões no terreno, provocando muito odor e se torna uma grande atração de moscas e insetos vetores de doenças. Ele pode se infiltrar na superfície, e por ser um produto bastante poluente, pode contaminar o solo e o lençol freático da região. Por outro lado, a combustão do material putrefato gera gases de efeito estufa, que afetam a camada de ozônio, aumentando o calor. Todos estes efeitos negativos, impactam na saúde pública do município pela ocorrência de agravos a saúde pública e gera aumento na demanda de atendimento nas Unidades Básicas de Saúde.
O que diz a lei sobre descarte e os lixões?
A Lei 12.305 de 2010 – Política Nacional de Resíduos Sólidos, determinou que até agosto de 2014 todos os lixões deveriam ser extintos no Brasil, entretanto, a data foi postergada para os anos seguintes e não aconteceu. Até o momento, poucos lixões foram extintos no Brasil e atualmente existem quase 3 mil lixões funcionando em 1.600 municípios brasileiros, segundo relatório da Associação Brasileira de Empresas de Limpeza Pública e Resíduos Especiais (ABRELPE). Recentemente, a Lei Federal Nº 14.026, de 15 de julho de 2020 que instituiu o Marco Legal do Saneamento Básico, estabeleceu os prazos através dos quais os municípios devem trabalhar para a extinção dos lixões e adotar tecnologias corretas de descarte dos resíduos em seus territórios. O não atendimento à legislação nesse sentido, tem consequencias negativas ao gestor municipal.
Coleta seletiva, logística reversa e a fiscalização
A PNRS determinou vários instrumentos para a gestão eficaz dos resíduos sólidos: (1) os planos de resíduos sólidos; (2) os inventários e o sistema declaratório anual de resíduos sólidos; (3) a coleta seletiva, (4) os sistemas de logística reversa e outras ferramentas relacionadas à implementação da responsabilidade compartilhada pelo ciclo de vida dos produtos. Ela criou (5) o incentivo à criação e ao desenvolvimento de cooperativas ou de outras formas de associação de catadores de materiais reutilizáveis e recicláveis; (6) o monitoramento e (7) a fiscalização ambiental, sanitária e agropecuária. Ela estatabeleceu tambem (8) a cooperação técnica e financeira entre os setores público e privado para o desenvolvimento de pesquisas de novos produtos, métodos, processos e tecnologias de gestão, reciclagem, reutilização, tratamento de resíduos e disposição final ambientalmente adequada de rejeitos; a educação ambiental. Estabeleceu também os incentivos fiscais, financeiros e creditícios; acordos setoriais, entre outros, a fim de facilitar e viabilizar a implantação de um sistema ambiental de descarte de resíduos.
Quem será responsabilizado pela (má) gestão dos resíduos no município?
A responsabilidade de cada cidadão gerador de resíduos, termina quando ele acondiciona os seus residuos adequadamente nas lixeiras em frente às suas casas, lojas, comércio, fazendo a separação dos orgânicos, dos inservíveis e dos recicláveis. A responsabilidade da prefeitura começa na coleta destes resíduos até o local de descarte. O responsável legal pela gestão correta dos resíduos sólidos urbanos pelo descarte correto e por extinguir o lixão, é definido no artigo 10 da Lei da PNRS. A responsabilidade é solidária, entretanto, incumbe ao Distrito Federal e aos Municípios a gestão integrada dos resíduos sólidos gerados nos respectivos territórios, sem prejuízo das competências de controle e fiscalização dos órgãos federais e estaduais do SISNAMA, do SNVS e do SUASA, consoante o estabelecido nesta Lei. Embora o governo Federal seja responsável enquanto repassador de recursos aos municípios, o prefeito municipal é o responsável civil e criminal pela existencia do lixão e/ou pela não cessação do dano ambiental gerado por ele. A cessação do dano ambiental deve ocorrer pela implantação de um sistema de tratamento e descarte ambientalmente correto e principalmente, pela extinção do lixão a céu aberto. O crime está tipificado no Artigo 54 da Lei de Crimes Ambientais, parágrafos 2º e 3º, abaixo.
§ 2º Se o crime…
I – tornar uma área, urbana ou rural, imprópria para a ocupação humana;
V – ocorrer por lançamento de resíduos sólidos, líquidos ou gasosos, ou detritos, óleos ou substâncias oleosas, em desacordo com as exigências estabelecidas em leis ou regulamentos:
§ 3º Incorre nas mesmas penas previstas no parágrafo anterior quem deixar de adotar, quando assim o exigir a autoridade competente, medidas de precaução em caso de risco de dano ambiental grave ou irreversível.
A responsabilidade de cada cidadão gerador de resíduos termina quando ele acondiciona os seus residuos adequadamente nas lixeiras em frente à sua casa. A responsabilidade da prefeitura começa na coleta destes resíduos e termina com o descarte na destinação final, mas este descarte precisa ser feito de forma correta. A responsabilidade em nível municipal pelo fazer, pelo não fazer ou pela omissão recai sobre o gestor municipal, entretanto, não isenta a responsabilidade dos assessores diretos responsáveis pela limpeza pública e pela gestão ambiental do município (por omissão, se assim procederem), caso não sejam promovidas ações pelo órgão municipal para fazer cessar o dano. Aos dois responsáveis pelas pastas citadas, cabe o papel e a responsabilidade de cobrar, alertar e notificar ao gestor municipal pela existência do dano ambiental e pela não-cessação dele e alertá-lo pela existência do crime contra o meio ambiente. A penalidade em forma de multa é dirigida à pessoa física e não à pessoa jurídica, enquanto funcionários públicos. Por outro lado, cabe ao órgão ambiental estadual, ao TCE e ao MPE solidariamente atuarem na fiscalização e cobrança quanto ao atendimento das leis, notificando os responsáveis, sempre que eles estiverem faltando ou deixando de exercer o seu papel neste processo.
Que prazo os municípios têm para extinguir os lixões?
De acordo com o novo marco do saneamento básico, capitais e municípios têm prazos definidos para extinguir lixões e implantar um sistema de tratamento e descarte correto dos resíduos sólidos, conforme abaixo:
a) Municípios com até 50 mil habitantes: 2021 a 2024
b) Municípios com 50mil a 100 mil habitantes, 2021 a 2023
c) Municípios com 100mil a 150 mil habitantes, 2021 a 2022
d) Capitais e municípios com mais de 150 mil habitantes, 2021
Se seu município ainda possui lixão a céu aberto, a Lei de Crimes Ambientais no Artigo 70, prevê que “qualquer pessoa, constatando infração ambiental, poderá dirigir representação às autoridades responsáveis”. Além disso, atualmente já existem modernas e eficientes tecnologias para tratamento e descarte de resíduos sólidos. Se seu município se enquadra em qualquer das situações acima, a hora para começar o processo de mudança é agora.
